KidSprout Terms of Service

Effective date: set to publication date when hosted · Operator: Akshana Enterprises LLC, a Massachusetts limited liability company (Sproutopolis / KidSprout)

Questions about these Terms: [email protected]

These Terms of Service ("Terms") govern your use of KidSprout (the website at kidsprout.app, the KidSprout mobile applications, and related services — collectively, the "Service"), operated by Akshana Enterprises LLC ("Akshana Enterprises LLC," "we," "our," or "us"), a Massachusetts limited liability company doing business as KidSprout.

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Service Description

KidSprout helps families in the United States discover and plan extracurricular activities for their children. The Service provides:

Provider directory information (names, addresses, categories, ratings, reviews) is aggregated from public sources including Google Places and supplemented with community-contributed content. KidSprout is an information and planning tool — parents book, pay, and communicate with providers directly. KidSprout is not a party to any transaction between a parent and a provider.

Metro-gated availability. KidSprout activates one metropolitan area at a time as the provider catalog reaches sufficient depth for personalized recommendations. In metros not yet covered, the Service displays a "coming to your area" state and no subscription charge is collected. When your metro is added, we will notify you before activating billing.

2. Eligibility and Account Responsibilities

Who may create an account. You must be at least 18 years old — and the parent or legal guardian of any child whose profile is created on the Service — to create a KidSprout account. By creating an account, you represent and warrant that you meet these requirements.

Child users. KidSprout is used by the parent or guardian on behalf of the family. Children do not create their own accounts and do not log in. Child profiles created on the Service are for family planning; the Service is not designed for use by children directly. See Section 6 for how we handle information about children.

Account security. You are responsible for maintaining the security of your account credentials. Do not share your login information. Notify us immediately at [email protected] if you believe your account has been compromised.

Accuracy. You are responsible for the accuracy of the information you provide, including your ZIP code, your child's Profile name, and your child's birth month and year used for age-appropriate recommendations.

One account per family. A single KidSprout subscription supports up to four child profiles on one account. See Section 3 for subscription details.

3. Subscriptions, Pricing, and Payments

3.1 KidSprout Subscription

KidSprout is a single-tier annual subscription covering all provider discovery, planning, events, and family calendar features across up to four child profiles on one account.

Local pricing outside the US is set at Stripe's regional equivalent and shown in your local currency at checkout.

3.2 Bundle with Bloomland

KidSprout is also available as part of a bundle with Bloomland (our language-learning app for kids, at bloomland.app). The bundle is a single annual subscription:

If you already hold a founder-rate subscription to Bloomland or KidSprout and later add the other product, you will pay the delta to reach the bundle-founder rate ($59/year) — not a new full-price subscription — and your combined subscription remains rate-locked at $59/year for life while continuously active. Cancelling one product returns the other to its own single-product founder rate.

3.3 Metro-gated Billing

Because KidSprout is a location-based service, we do not collect subscription payment for metros that are not yet covered by our provider catalog. If you sign up in an uncovered metro:

3.4 Billing via Stripe

All KidSprout subscriptions are purchased and managed through Stripe at kidsprout.app.

3.5 Mobile App Access to Your Subscription

Your subscription entitlement is tied to your KidSprout account, not to any specific device or platform. Once you have subscribed at kidsprout.app, sign in to the KidSprout iOS or Android app with the same credentials and your paid content unlocks automatically. In-app purchases via Apple's App Store or Google Play are not used at launch.

3.6 Refunds

KidSprout offers a 14-day money-back guarantee on the initial subscription purchase. To request a refund, email [email protected] within 14 days of your first charge and we will issue a full refund via Stripe. Refunds for renewal charges after the first year are considered on a case-by-case basis; contact [email protected].

3.7 Price Changes

We may adjust the regular subscription rate over time. Founder-rate subscribers remain at their locked-in rate for as long as their subscription is continuously active. For all other subscribers, we will provide at least 30 days' notice via email before any price increase takes effect at the next renewal.

4. Provider Information and Bookings

KidSprout provides information about activity providers, but is not a party to any relationship between you and a provider. You are responsible for:

We do not guarantee that provider directory information is current, complete, or accurate. Provider data is aggregated from public sources and may lag reality. Where a provider has claimed and self-updates their KidSprout listing, we will indicate that; otherwise, treat listings as informational.

Reviews. Some listings display reviews sourced from public data (e.g., Google Places) or contributed by KidSprout users. Reviews are the opinions of their authors and do not reflect the views of Akshana Enterprises LLC. We do not verify individual reviews.

5. Recommendations and AI-Assisted Content

KidSprout's activity, event, and competition recommendations are computed from your child's profile, provider data, event feeds, and geographic proximity. Some components of the ranking, matching, and content-normalization pipeline use machine-learning and generative-AI techniques. Recommendations are suggestions only — they are not professional advice, not endorsements, and not guarantees of fit.

You are solely responsible for evaluating whether a recommended activity is suitable for your child, including safety, developmental appropriateness, and family fit. If you notice a low-quality or off-topic recommendation, report it to [email protected] and we will investigate.

6. Children's Information

Our collection and use of information about children is governed by the KidSprout Privacy Policy. In summary:

KidSprout operates in compliance with the Children's Online Privacy Protection Act (COPPA) and analogous state and international frameworks.

7. Content License

Subject to your compliance with these Terms and payment of any applicable subscription fees, Akshana Enterprises LLC grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service and its content (provider directory, recommendations, editorial content, event listings, and family-planning tools — collectively, "Content") for your personal, non-commercial, family-planning use.

You may not:

All Content is owned by or licensed to Akshana Enterprises LLC and is protected by copyright and other intellectual property laws. The KidSprout name, logo, and associated marks are the intellectual property of Akshana Enterprises LLC.

Your submissions. If you submit content to the Service (for example, a review of a provider), you retain ownership but grant Akshana Enterprises LLC a worldwide, royalty-free, non-exclusive license to display, distribute, and reproduce that content within the Service for its normal operation. You represent that you have the right to submit such content and that it does not violate any third-party right or applicable law.

8. Acceptable Use

You agree not to:

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR CURRENTNESS OF ANY PROVIDER DIRECTORY INFORMATION, REVIEW, OR RECOMMENDATION.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AKSHANA ENTERPRISES LLC'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES YOU PAID TO AKSHANA ENTERPRISES LLC IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00).

IN NO EVENT WILL AKSHANA ENTERPRISES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Provider engagement. Akshana Enterprises LLC is not responsible for the acts, omissions, quality, safety, or availability of any activity provider listed on the Service. Any claim arising out of your engagement with a provider (including but not limited to enrollment disputes, injury, dissatisfaction with instruction, or provider cancellation) is between you and the provider.

11. Indemnification

You agree to indemnify, defend, and hold harmless Akshana Enterprises LLC and its officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your breach of these Terms; (c) any content you submit through the Service; (d) your engagement with any activity provider listed on the Service; or (e) your violation of any third-party right or applicable law.

12. Termination

By you: You may cancel your subscription at any time through the billing portal at kidsprout.app or by emailing [email protected]. Cancellation takes effect at the end of your current billing period; you retain access until then. To delete your account entirely, see Section 13.

By us: We may suspend or terminate your access to the Service if you violate these Terms, engage in conduct we deem harmful to other users or the Service, or for any other reason with reasonable notice. Upon termination for cause, no refund will be issued outside of the 14-day money-back guarantee in Section 3.6.

Upon termination for any reason, your license to use the Content ends immediately.

13. Account Deletion

To request permanent deletion of your account and all associated data:

  1. Sign in at kidsprout.app → Settings → Delete Account (type-DELETE-to-confirm flow), or
  2. Email [email protected] with the subject "Delete my KidSprout account."

Deletion terms are as described in our Privacy Policy (Section 5). Deletion is permanent: your account, your child profiles, your saved providers, your reviews, and your family plan will all be removed. Subscription cancellation is separate from account deletion; cancel via the billing portal (see Section 12) first, then request deletion if desired.

14. Binding Arbitration and Class-Action Waiver

Informal resolution first. Before filing any legal claim, contact us at [email protected] and describe your dispute. We will attempt to resolve it within 30 days.

Binding arbitration. If informal resolution fails, any dispute arising out of or related to these Terms or the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, seated in the Commonwealth of Massachusetts. The arbitrator's decision is final and binding.

Class-action waiver. YOU AND AKSHANA ENTERPRISES LLC EACH AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. IF THIS WAIVER IS FOUND UNENFORCEABLE, THE ARBITRATION CLAUSE WILL NOT APPLY TO THE CLASS CLAIM.

Opt-out. You may opt out of this arbitration clause within 30 days of first accepting these Terms by emailing [email protected] with the subject "Arbitration Opt-Out." Opting out does not affect any other provision of these Terms.

Exceptions. Either party may seek emergency injunctive or equitable relief in a court of competent jurisdiction to prevent irreparable harm.

15. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs the arbitration clause in Section 14. Subject to the arbitration provisions in Section 14, any court proceeding arising out of or related to these Terms shall be brought exclusively in the state or federal courts located in Massachusetts, and you consent to the personal jurisdiction and venue of those courts.

16. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email to the address on your account and by posting a notice within the Service. Continued use of the Service after the effective date of an updated version constitutes acceptance of the updated Terms.
